Harry Lyon Is Off the Democratic Ballot

Praise the Lord and the ADP -- Harry Lyon is no longer the Democratic nominee for Chief Justice of the Alabama Supreme Court.

The qualifying period for other candidates opens Monday and runs through noon on Wednesday.  

This has been a spectacle, but the job in question is an extremely serious one -- the Chief Justice manages the entire Alabama court system.  Voters deserve a serious, qualified candidate; hopefully one will emerge next week.

Statement from Alabama Democratic Party Chairman Mark Kennedy on the Disqualification of Harry Lyon as Nominee for Supreme Court Chief Justice

"It is the decision of the State Democratic Executive Committee that Mr. Lyon clearly violated the state party's by-laws and this, along with his increasingly erratic behavior, have undermined his ability to stand as a candidate for the Democratic Party."

On Monday August 13, 2012, the State Democratic Party sent Lyon a letter outlining a series of increasingly disturbing behavior that violated the Party's bylaws and the Canons of Judicial Ethics including an apparent inability to conduct himself in a manner that promotes public confidence in the integrity and impartiality of the judiciary and an apparent inability to maintain the decorum and temperance befitting the office of Chief Justice.

In accordance to the same by-laws, Chairman Kennedy called for a meeting of the State Executive Board to take up the matter. This afternoon a five-member subcommittee of the Board met and voted to disqualify Lyon. The Board then set next steps to ensure the Party would be represented in this race in November.

"It is disappointing that this close to the election process we find ourselves without a candidate for Chief Justice, but are hopeful that we will soon have a truly qualified candidate and future Chief Justice," said Kennedy. 

The Party will open a qualifying period for potential replacement candidates.  The qualifying period will open Monday, August 20, 2012 at 8:00 AM and close Wednesday, August 22, 2012 at noon.  If no candidate qualifies during the qualifying period, there will be no Democratic nominee for Chief Justice.  If only one candidate qualifies, that candidate will become the Democratic nominee.  If more than one candidate qualifies, ballots will be mailed on Wednesday, August 22, 2012 to the full membership of the State Democratic Executive Committee.  Ballots will be due on Monday, August 27, 2012 by 5:00 PM to the Democratic Party Headquarters.

Dean John Carroll at Cumberland School of Law. The guy has a stellar resume and reputation, worked for the SPLC, has been a member of the federal judiciary, is a Marine vet of Vietnam and an all around baller from those I've spoken to at the law school.

good. maybe this will get enough public attention to generate real interest in whoever becomes the dem nominee. then it's up to him or her and us to capitalize on it. 

BOB VANCE WILL BE THE NOMINEE (4.00 / 5)

Circuit Court Judge in Jefferson County. Well respected and in many folks opinion possibly the finest jurist in the State. 

Husband of U.S. Attorney Joyce Vance

father was Federal Judge Robert Vance who was assassinated in 1989

He will mount a strong campaign but we know that it will be tough to knock off Roy. I think this is good for rebuilding the structure of the State party. 



Judge Bob Vance (4.00 / 4)

is the perfect candidate to run against Roy Moore. Judge Vance is universally respected as a scholarly and fair judge who decides cases based solely on the law and the facts. While the Republican nominee stands for ignoring the law if you happen to disagree with it, Judge Vance has exemplified the kind of jurist that we should all hope to have on the Supreme Court.

Now what I need the ADP to do is actually lobby and campaign for this man to have a fan campaign rather than just place somebody up there without supporting him...

That is one thing this state's Democratic party doesn't seem to do very well is support and campaign so that these people stand a chance.
