RANT: Legislating Civil Rights, a Very Bad Idea

by: melmel

Imagine if voters back in the 60s could go to the polls and vote on whether or not to desegregate. In how many states would that referendum have passed? Hmmm... my guess is ZERO!

Civil rights are just that, RIGHTS!  People should not be allowed to choose them for others that are "DIFFERENT".

You don't have to think back too far to see how this is never a good solution.  Remember the Equal Rights Amendment, fondly remembered as the E.R.A.? It was a very noble attempt to gasp give women the same rights as men. It gave flight to right wing groups like Phyllis Schlafly's Eagle Forum.  If the Eagle Forum still exists it is probably a very vocal tea-bagging group today.

And now, we are allowing religious prejudice and right wingers to determine who can and can not marry.  Maine pulled a California, with help from the Catholics instead of the Mormons. This is especially galling:

The Catholic Church was a leading supporter of the repeal campaign, even asking parishes to pass a second collection plate at Sunday mass to help the cause.

Thank goodness not all religious people are so close-minded and hateful.  Here is a fabulous speech by the (reitired) Episcopal Bishop Spong.

I will no longer temper my understanding of truth in order to pretend that I have even a tiny smidgen of respect for the appalling negativity that continues to emanate from religious circles where the church has for centuries conveniently perfumed its ongoing prejudices against blacks, Jews, women and homosexual persons with what it assumes is "high-sounding, pious rhetoric."

God help us if this trend continues in this country. If you are a religious person then please pray for a strong supreme court that can sort out this kind of bigotry and call it like it is. And religious or not-speak out at the injustice that results from mass bigotry!

My thoughts exactly! (4.00 / 2)

That's what I've been saying all along! I think it's downright shameful that this was even up for vote in the first place. Our country was not founded upon idea that the civil rights of others is up to the popular vote--the very opposite is the case, in fact.

This was an excellent post! I really needed that. Last night felt like a huge punch in the gut to me. I even cried. I thought we stood the chance of a major victory in Maine.

Shykid, you didn't cry alone. (4.00 / 2)
The day will come and it will be in our lifetime.

I'm so sorry! (4.00 / 2)
I am stunned at the outcome in Maine.

...Endowed, by their Creator, with certain unalienable Rights (4.00 / 2)

that among these are Life, Liberty, and the Pursuit of Happiness.

Seems pretty cut and dried to me, but once again America has fallen short of that ideal.

I was too mad at being hit to cry (4.00 / 2)
If you haven't seen it yet, I highly recommend Harry Knox's musings after the Maine vote. I don't share all his religious convictions but his words touched me.

Once again, when American voters have had an opportunity to affirm my humanity and the loving commitment I have made to my husband, a majority of those voters have made a conscious decision to deny my humanity and treat me as if my citizenship and my marriage mean nothing; all the while patting themselves on the back for their piety. The slap they intended is received.

Today I am tempted to feel like an exile in my native land - to question who and what I am. But this I know: in the end it matters not one whit what others say or believe about me and mine. What matters, today and forever, is what we believe about ourselves.

Oh wow, that is simply beautiful in a sad sort of way. (4.00 / 1)
Such heartbreak there. These ballot initiatives must end.

I realize in my emotional rant I used the word "legislate" in the title. (4.00 / 2)
Maybe the better word would have been "Voting". Oh well, the rant still stands.

Can I start Screaming now ? (4.00 / 3)
I really want to just scream at some of them :(

Me too, dude. Me too. :( (4.00 / 3)
I'm not even sure what to say or feel. I'm frustrated more than anything. Frustrated and really damn disappointed. I just wish people could understand what shit like this feels like when it's them and their rights being voted away by a bunch of fundamentalists who don't give a rat's ass about the "sanctity" of marriage until someone they don't like stands a chance to get it.

Please hang in there, y'all. (4.00 / 1)
This is not fair and I can't imagine how hard it must be if you're one of the people being targeted for hate by those bent on using fear and division to manipulate elections, but I truly believe a better time will come and it won't be too very much longer. We have seen progress in the last decade.  God willing, that progress will grow and accelerate, like a snowball rolling downhill. Basic human rights and dignity for every citizen. We shouldn't rest until we achieve that.

Work harder and work smarter!

Kudos melmel. (0.00 / 0)
Your rant verbalized why I oppose I&R ballot initives.  Civil rights should not be legislated which is what I fear would happen in Alabama considering the current political climate, coupled with the big bucks spent by the special interest and the mega churches.

Rant On!  Rant Often!

The work goes on, the cause endures, the hope still lives and the dreams shall never die.~Senator Edward M. Kennedy (D. MA)
